Thailand Cracks Down on Foreign Nominee Businesses Across Island Provinces

Thailand is tightening its grip on suspected nominee businesses, with fresh inspections on Koh Phangan and Koh Samui uncovering thousands of foreign-linked companies operating in breach of local ownership rules. The move, announced earlier today, signals a broader push to enforce regulations in key tourism hubs.

Authorities carried out targeted checks over the past week, revealing widespread use of Thai nominees to mask foreign control in sectors ranging from hospitality to retail. Officials described the findings as a wake-up call for investors who skirt the rules.

Key Findings on Koh Phangan and Koh Samui

On Koh Phangan, inspectors flagged more than 1,200 companies with questionable ownership structures. Similar patterns emerged on Koh Samui, where roughly 2,800 foreign-linked firms came under scrutiny. Many operated bars, villas, and dive shops that should be majority Thai-owned under current law.

"These inspections show that nominee arrangements remain common despite repeated warnings," a senior Department of Business Development official told reporters this morning. The probe focused on businesses that appear Thai on paper but are effectively run from abroad.

Nationwide Expansion Underway

The crackdown will not stop at these two islands. Starting next week, teams will move into Phuket, Chonburi, Phang Nga, and Prachuap Khiri Khan. Officials expect similar patterns to surface in these high-traffic tourist zones.

The expanded checks aim to level the playing field for legitimate Thai entrepreneurs while protecting the integrity of foreign investment rules. Penalties can include heavy fines, forced restructuring, or even business closure.

Impact on Tourism and Local Economy

Koh Phangan and Koh Samui remain vital to Thailand's tourism recovery. Last year the islands welcomed millions of visitors drawn to Full Moon parties, pristine beaches, and world-class diving. Yet unchecked nominee businesses can distort competition and drain revenue from local communities.

Industry watchers say clearer enforcement could ultimately strengthen investor confidence by removing gray-area operators. At the same time, foreign owners who have built genuine partnerships with Thai stakeholders are expected to face minimal disruption.

What Nominee Businesses Mean in Thai Context

Thai law restricts foreign ownership in many small and medium enterprises to protect local interests. Nominee structures—where a Thai citizen fronts as the owner while control rests overseas—violate these provisions. The practice has long drawn criticism from both regulators and honest business owners.

Today's announcement builds on earlier efforts in Krung Thep and other provinces. The government has signaled that digital records and inter-agency data sharing will speed up future detections.

Thailand continues to welcome foreign capital that plays by the rules. The message from today's inspections is clear: the era of easy workarounds is ending.
